1. Introduction
Welcome to Cognify ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our AI-powered Cognitive Task Analysis platform, website, and related services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy.
We may update these Terms from time to time. If we make material changes, we will notify you through the Services or by other means to provide you the opportunity to review the changes before they become effective. Continued use of the Services constitutes acceptance of the revised Terms.
2. Definitions
- "Platform" Refers to the Cognify neural analytics infrastructure, including all proprietary algorithms, AI models, and dashboard interfaces.
- "User Data" Any data, recordings, signals, documents, or metadata uploaded or submitted by the User to the Platform for analysis or processing.
- "Insights" The processed results, visualizations, reports, and analytics generated by Cognify's proprietary AI and algorithms.
- "User Content" Any knowledge, documents, processes, media, expert inputs, or other content you submit to the Services.
3. Account Obligations
To access certain features of the platform, you must register for an account. You agree to use the Services lawfully and to:

- check_circle Not use the Services to generate content that is illegal, harmful, or violates the rights of others.
4. Data & Privacy
Your privacy is critical to us. Cognify employs enterprise-grade encryption for all data at rest and in transit.
All data is encrypted using AES-256 standard and managed via Hardware Security Modules (HSM).
Our data handling processes are SOC2 Type II and HIPAA compliant for clinical research environments.
5. Usage License
Your Expert Knowledge
You retain 100% ownership of your cognitive data, process maps, domain inputs, and any content you provide.
Subject to your compliance with these Terms, Cognify grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for your internal business or research purposes.
- Your Content You retain all rights, title, and interest in and to the data, text, and expert knowledge you submit to the Services. You grant us a worldwide, non-exclusive license to use, reproduce, and display User Content solely as necessary to provide the Services to you.
- Our Platform The Services, software, interface, trademarks, AI systems, algorithms, and related intellectual property remain the exclusive property of Cognify and its licensors.
- Feedback Feedback you voluntarily provide may be used to improve the Services without obligation to you.
Restrictions:
You may not reverse engineer, decompile, or attempt to extract the source code of the Platform's neural processing models. You may not use the Services to violate applicable law or the rights of others.
6. Enterprise Terms
If you are using the Services on behalf of an organization under a separate Master Services Agreement (MSA) or Enterprise Agreement, that agreement controls to the extent of any conflict with these Terms.

The terms of your MSA or Enterprise Agreement will take precedence over these Terms of Service in the event of any conflict.

Specific Service Level Agreements (SLAs), support commitments, and organization-specific security or compliance obligations are defined in your enterprise contract.
7. Limitation of Liability
To the fullest extent permitted by law, Cognify shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Services.
Our aggregate liability for all claims relating to the Services shall not exceed the greater of $100 USD or the amount you paid to Cognify during the preceding twelve months.
8. Termination
We may suspend or terminate your access to the Services immediately, without prior notice or liability, if you violate these Terms or applicable law. Upon termination, your right to use the Services will immediately cease.
